This website: www.the-moment.io ("Site") is owned and operated by MO MENT MEDIA WORLD LLP ("Company"). Through the Site, the Company allows users to access journalistic content basis the payment of a subscription fee ("Services"). The terms 'Company' or 'us' or 'we' refer to the owners of the Site. The term 'you' refers to the subscriber of the Services on the Site.
1. Acceptance of Terms
By accessing or using the Site, you agree to comply with and be bound by these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. The Company provides the Services subject to the conditions set forth in these Terms and you will be subject to the same upon subscribing to the Services. The Company reserves the right to change or modify the Site, the content of the Site and these Terms anytime without any prior intimation to you. All modifications will be posted on the Site and upon such posting, will become effective immediately.
2. Eligibility
You will only be eligible to subscribe to the Services on the Site if you comply with requirements set forth under the Indian Contract Act, 1872. A person is found to be in compliance under the Indian Contract Act, 1872, if they are above Eighteen (18) years of age, are of a sound mind and not disqualified from contracting by any law to which they might be subject.

3.1 Registration
Certain features of the Site may be accessible by subscription only. You can subscribe to the Services on the Site only after registering with the Site. You shall have to confirm that you have read, understood and agree to these Terms, as well as the Privacy Policy available at https://the-moment.io/privacy-policy.
3.2 Security
Information to be provided by you at the time of the registration may include email address, name, age, billing address, date of birth and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. All actions performed on your account shall be deemed to be performed by you. Notify us immediately of any unauthorized use or security breach.
4. Paid publication services
4.1 Subscription
To access certain features and content of the Site, you will need to subscribe to the Services through the payment of a subscription fee. By subscribing to these Services, you agree to pay the specified fees and charges. The nature of content made available to you is subject to change, the final decision of which lies with the Company. The Company may vary the access rights of users engaged in accessing the Site without a paid subscription at any time at the Company's sole discretion.
Submission of subscription details and making a successful payment only constitutes an offer you make to us to buy a subscription. We will accept your offer and execute a contract only upon successful verification of your payment details and email address, at which point we will provide you with access to your subscription. The Company reserves the right to reject any offer in its discretion, for any or no reason.
4.2 Payment
The subscription fees and any other charges in connection with your subscription for the Services shall be as per the rates in effect at the time when it is charged. At the time of purchasing a subscription, you need to provide complete and accurate payment information. The act of submitting payment information means you are entitled to use said payment information to purchase a subscription. Access to your subscription will be cancelled immediately in case of any subsequent cancellation of payment authorization. We may contact the relevant payment provider and/ or relevant law enforcement agencies and/ or other appropriate third parties in case of any suspicious activity. In case of any refunds that you are entitled to under these Terms, the refund will be credited through the payment method used by you. In case your payment method has expired, we will get in touch with you regarding next steps.
Given the Company uses third-party payment service providers to process payments towards subscription of Services, the Company shall not be responsible for any failed or incomplete payments based on instructions issued by you through such service provider. Your usage of such providers shall be in accordance with the terms and conditions put forth by such third-party service provider.
Fee charged towards subscription of Services will be billed at the beginning of your subscription period and any renewal of the said subscription. As a general matter, all our fees and charges are non-refundable. The Company reserves the right to issue refunds or credits at its sole discretion. If the Company does issue a refund or credit, it is under no obligation to issue the same or any similar refund in the future. We may change the Subscription Fees and charges then in effect, or add new fees or charges which will take effect at the end of your subscription period, by giving you notice in advance and an opportunity to cancel.
4.3 Pricing
Current schedule of subscription fee along with the term and duration of subscription to Services is available at https://the-moment.io/subscription. The Company may revise the subscription fee from time to time and/ or across geographies at its sole discretion. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your subscription.
Subscription and access to content services fall under the purview of Taxation as per the current indirect taxation policy of the Government of India. Unless otherwise indicated, prices stated on our Site are inclusive of all applicable taxes.
4.4 Term, Renewal and Cancelation
You can choose a subscription along with the term and duration as offered by the Company on https://the-moment.io/subscription. These Terms shall remain in full force and effect while you use the Services. Your subscription will renew automatically until it is cancelled in accordance with this section. For all subscriptions, you must cancel your subscription before it renews in order to avoid billing of subscription fees for the renewal term.
Subscription to the Site commences immediately on the realisation of payment of the Subscription Fees, and there can be no cancellation once the subscription is active.
For subscriptions with annual payments, The Company will notify you of the pending subscription renewal along with the rate that will apply for the renewal period at least 15 days prior to each renewal, except as otherwise required by law. In case you wish to cancel, you will need to notify us before the end of your subscription period. Failure to do so will lead to automatic renewal of your subscription at the notified rate and the payment method used by you previously will be used to charge you. The revised rate will also be used for all subsequent renewals unless notified otherwise by the Company.
For subscriptions with monthly payments, in case of any price changes, The Company will notify you of the same at least 15 days prior to your next renewal, except as otherwise required by law. In case you wish to cancel, you will need to notify us before the end of your subscription period. Failure to do so will lead to automatic renewal of your subscription at the notified rate and the payment method used by you previously will be used to charge you. The revised rate will also be used for all subsequent renewals unless notified otherwise by the Company.
You do not have any right to cancel your subscription or any part of it until the end of your then current subscription period. Although you may notify us of your intention to cancel at any time, such notice will only take effect at the end of your then current subscription period, and you will not receive a refund.
5. Termination
The Company reserves the right to terminate or suspend your access to the Site and its Site at its sole discretion, with or without notice, for any reason, including if you violate these Terms.
The Company may, in exceptional circumstances, cease to publish the Site, the Site content or cease to provide Services. The Company will give you at least 15 days' notice of this, if possible. If we do so, then we will have no further obligation to you except for a refund of the unexpired period of your paid subscription. This means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription.
6. Intellectual Property
6.1 Content Ownership
All content on the Site, including text, graphics, illustrations, images, icons, buttons, logos, and other materials, is the property of the Company or its licensors and is protected by copyright and other intellectual property laws that are owned and controlled by us or the other parties that have licensed their material to us. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly and you must not assist any other person to do so.
6.2 License

11. Applicable Law
This Site, including the content and contributed content and information contained herein, and the provision of Services shall be governed by the laws of the Republic of India and the courts of New Delhi, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same. As such, the laws of India shall govern any transaction completed using this Site.
